I, hereby acknowledge and declare that I have voluntarily purchased an electric bicycle (“eBike”) from GhostCat Bikes LLC. As a condition of this purchase, I understand and agree to the terms and conditions outlined in this release of liability waiver.
Assumption of Risk:
I am aware that operating an eBike involves certain inherent risks and hazards, including but not limited to accidents, property damage, bodily injury, and even death. I voluntarily assume all risks associated with the use, ownership, or operation of the eBike.
Release and Indemnification:
In consideration of the sale and delivery of the eBike, I hereby release and discharge GhostCat Bikes LLC from any and all claims, liabilities, actions, demands, expenses, and costs, whether present or future, known or unknown, arising out of or in any way connected to the use, ownership, or operation of the eBike. I further agree to indemnify and hold harmless GhostCat Bikes LLC from any claims or actions brought against them by any third party in connection with the use of the eBike.
Warranty:
GhostCat Bikes LLC (“Company”) offers a limited one-year warranty on all new bike purchases for the original retail purchaser. This warranty is valid from the date of delivery to the original owner and is non-transferable. Proof of original purchase receipt is required for valid warranty coverage.
Under the warranty, the Company will, at its discretion, replace any parts or components of the Product that are found to be defective in materials or workmanship during the warranty period. This warranty covers manufacturing defects that occur under normal use conditions. Normal wear and tear that occurs with regular use is not covered within the warranty.
The warranty covers the following major parts and components for 1 year from the delivery date, provided the bike is used and maintained regularly: Frame, Motor, Battery, Controller, Display, Throttle, Headlight, Taillight, Rear and Front Suspension, and Crankset. The battery is subject to a gradual capacity reduction, which is considered normal and is not covered unless the capacity drops below 80% of its original capacity within the warranty period.
To file a warranty claim, the original retail purchaser must submit a support ticket through the Company’s website, selecting “Technical Support/Warranty” in the subject line. The purchaser must provide evidence of the defect, such as pictures or videos, for the team to assess.
To qualify for the warranty, the following conditions must be met:
– The purchaser provides evidence that the bike was bought from GhostCat LLC within the last 12 months from the delivery date.
– The individual seeking warranty coverage is the original and first owner of the bike (the warranty is not transferable in the event of a re-sale).
– The bike has not been modified with any third-party critical components (motor, battery, controller, display).
The warranty does not cover the following:
– Normal wear and tear of the product due to regular use.
– Damage or failure resulting from abuse, neglect, misuse, or accident.
– Damage caused by stunt riding, jumping, or any activity that is inconsistent with the intended use of the bike.
– Damage to the battery caused by using a third-party charger.
– Paint damage or rust.
– Installation of any third-party parts, accessories, or electrical or mechanical components.
– Lost or damaged keys.
The Company’s liability under this warranty is limited to the replacement of defective parts and components. The Company is not liable for any indirect or consequential damages, loss of use of the Product, or any other expenses or losses incurred due to a warranty claim.
This warranty policy is subject to change without notice, and the Company reserves the right to modify or discontinue this policy at its discretion. Any modifications will not affect the warranty coverage of the Products sold before the change in policy.

I acknowledge that GhostCat Bikes LLC has provided me with information regarding the eBike, including its specifications, features, and limitations. I understand that GhostCat Bikes LLC makes no warranties, either expressed or implied, regarding the eBike’s fitness for a particular purpose or its merchantability. I assume full responsibility for the selection, use, and maintenance of the eBike.

Compliance with Applicable Laws:
I agree to comply with all federal, state, and local laws and regulations governing the operation of eBikes, including but not limited to traffic laws, licensing requirements, and safety standards. I understand that failure to comply with these laws may result in legal penalties. I agree to take responsibility in determining the proper eBike classifications per Country, State and Local regulations. GhostCat Bikes LLC is not responsible for determining eBike classification regulations, this is the sole responsibility of the buyer/owner of the eBike before purchase. I agree that the bike will be used for private off-road use only when the bike’s speed is unlocked through advance settings with instructions from GhotCat Bikes LLC. I am aware of the dangers of unlocking the bike’s speed and inherent risks and hazards, including but not limited to accidents, property damage, bodily injury, and even death. I voluntarily assume all risks associated with unlocking the off-road mode and adjusting the speed from the factory settings.
Severability:
If any provision of this release of liability waiver is found to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.
I have read this release of liability waiver carefully and understand its contents. I acknowledge that I am signing this document voluntarily and without any duress or undue influence.
